Booking and formation of the contract
The booking becomes binding once three conditions are met: the guest has accepted these terms by ticking the box provided, the advance payment has been made, and the owner has sent written confirmation by e-mail.
The rental contract is formed by the booking confirmation, the detailed description and these terms. The guest guarantees the accuracy of the information provided and completes, before arrival, the guest form indicating the identity of each occupant.
The booking is personal and may not be transferred or sublet. The holder must be of legal age and present during the stay.
The minimum length of stay ranges from 1 to 7 nights depending on the period. The applicable length is indicated at the time of booking.
Price and payment
Prices are shown in euros, all charges included: water, electricity, heating, fibre wifi, bed and bathroom linen, and end-of-stay cleaning.
The tourist tax is not included in the price of the stay. It is calculated according to the rate set by the municipality of Montgenèvre, including the additional departmental tax, and applies only to adult occupants, minors being exempt. Its amount appears on the price summary and is paid by secure payment link 3 days before arrival, together with the security deposit.
- On booking
- Advance payment of 50% of the stay price
- Balance
- 30 days before arrival
- Late booking
- Less than 30 days before arrival, the full amount is paid on booking
- Payment methods
- Bank card via the secure booking module, or bank transfer. For transfers, the booking is confirmed on receipt of funds.
Sums paid in advance constitute an advance payment (acompte) and not earnest money (arrhes) within the meaning of Article L. 214-1 of the French Consumer Code. If the balance is not paid by the due date, the owner may, after a reminder left without effect for 72 hours, consider the booking as cancelled by the guest.
No right of withdrawal
Article L. 221-28, 12° of the French Consumer Code
The provision of accommodation for a specific date or period does not give rise to the 14-day right of withdrawal. Any cancellation is therefore governed solely by the conditions below.
Cancellation
By the guest
Cancellation is made by e-mail. The 50% advance payment made on booking is retained by the owner in all cases; what happens to the rest depends on the date of cancellation:
A late arrival, early departure or no-show gives rise to no refund.
We recommend taking out cancellation insurance with the insurer of your choice.
By the owner
If the owner has to cancel, they refund all sums paid without delay. The guest may also claim compensation for the loss suffered, except in the event of force majeure.
Force majeure
Neither party is liable for non-performance due to force majeure within the meaning of Article 1218 of the French Civil Code. The sums paid for the nights that could not be provided are then refunded.
Security deposit
A security deposit of €1,500 is set up online by bank card via the Swikly deposit service, no later than 3 days before arrival. The access codes are only sent once the security deposit is registered. No amount is charged if the accommodation is returned in good condition.
The security deposit is released 7 days after departure. In the event of damage, loss, manifestly insufficient cleaning or failure to comply with the house rules, the owner may, within this period, request payment of all or part of the deposit on presentation of supporting documents (photos, quotes, invoices). The guest is informed by e-mail and may submit their observations. If the loss exceeds the deposit amount, the guest remains liable for the difference.
Arrival and departure
Check-in is self-service, by keypad, from 4 pm. The access codes and instructions are sent after payment of the balance and registration of the security deposit. Check-out is before 10 am. An early arrival or late departure may be requested and are granted subject to availability.
An inventory is available in the accommodation. Any anomaly must be reported within 24 hours of arrival; failing this, the accommodation is deemed to have been handed over in good condition and in accordance with the inventory.
On departure, the accommodation is left tidy, dishes done, bins emptied into the residence containers and keys or badges returned to the indicated place.
Use of the accommodation
- 4 occupants maximum, infants included. Any additional person must be accepted in writing beforehand.
- Non-smoking accommodation, including the balcony. Parties and events are prohibited.
- Pets are not allowed.
- Skis, boots and equipment are stored in the cellar fitted as a ski room, not in the apartment.
- The co-ownership rules of the La Vieille Douane residence apply, in particular quiet hours between 10 pm and 8 am.
- The equipment (decorative water-vapour fireplace, fibre-optic starry sky, appliances) is used according to the welcome booklet instructions.
In the event of a serious breach, the owner may end the stay without refund.
Resort, snow and weather
Snow conditions, the weather, the total or partial closure of the ski area or lifts and the cancellation of resort events do not depend on the owner. They do not constitute grounds for cancellation or refund, unless access to the accommodation is made impossible by an administrative decision.
Insurance
The guest must be covered by holiday civil liability insurance for any damage they may cause to the accommodation, the residence or third parties. A certificate may be requested before arrival. The owner is insured for the accommodation as a furnished tourist rental.
Complaints and personal data
Any complaint relating to the stay is sent in writing to hello@lao1860.com, preferably during the stay to allow a prompt response, and no later than 15 days after departure.
The data collected when booking is processed as described in our Legal notice.
Mediation and applicable law
Articles L. 612-1 et seq. of the French Consumer Code
In the event of a dispute, the guest first sends a written complaint to the owner. Failing an agreement, they may refer the matter free of charge to the consumer mediator CM2C (www.cm2c.net), within one year of their written complaint.
These terms are subject to French law. Failing an amicable solution, the dispute is brought before the competent court under the rules of ordinary law.
